US tightens rules on demurrage, detention fees

The US Federal Maritime Commission (FMC) has established new regulations, limiting ocean carriers and marine terminal operators (MTOs) in imposing container demurrage and detention charges against shippers.

The new Rule introduces new conditions for how carriers and MTOs must bill for container demurrage and detention charges, FMC has reported on its website.

Demurrage: Fees charged when FULL CONTIANERS have not been picked up by customers after the free days are over.

Detention: Fees charged if EMPTY CONTAINERS are returned late (after certain free days) back to the terminal.

 

The new rule will be effective from May 2024.
